Vehicle rental fraud: the warning signs to spot

The three families of vehicle rental fraud, the weak signals to catch at the counter, and the steps a French agency takes once it has happened.

Fraud in vehicle rental is almost never a technical feat: it is an inconsistent file that nobody had time to look at closely. Three families come round again and again, identity and supporting documents, the means of payment, and misappropriation of the vehicle, and the only defence that holds up over time is a written procedure, the same for everyone, applied at the counter and remotely alike.

So you do not spot a fraudster by intuition, you spot an inconsistency between documents: a cardholder who is not the driver, an address that does not match the proof of residence, a last-minute departure on the most expensive vehicle in the fleet late on a Friday. Taken alone, none of this proves anything; stacked up, it justifies one more check before you hand over the keys.

Viktigt att veta
  • Fraud shows up as inconsistency between documents, never through intuition or a customer's appearance.
  • A written procedure, applied to everyone the same way, is also your legal protection.
  • The means of payment is the most useful checkpoint: cardholder, card type, pre-authorisation accepted.
  • A joint, time-stamped condition report remains the decisive document in any dispute.
  • If a vehicle is not returned, the formal notice to comply and the criminal complaint are two distinct steps.

Three families of fraud, three mechanisms

Understanding the mechanism beats memorising a list of typical profiles. In all three cases the fraudster exploits the same blind spot: the moment the vehicle leaves the agency while the file is not yet solid.

Identity and supporting documents

Obtaining a vehicle under an identity that is borrowed, falsified, or assembled from documents belonging to several people. A rental operator has no access to the French national driving licence register: all it can check is the original document and how it fits the rest of the file. Hence the value of holding the document in your hand, comparing the photograph with the face, insisting on the original rather than a photocopy or a picture on a phone, and confirming that the name is the same on the licence, the identity document and the means of payment. For a customer arriving from abroad, ask for the national licence, accompanied by an international permit where the rules require one, checking with the official French source.

The means of payment

Here the fraud consists in opening a gap between handover of the vehicle and final settlement: a stolen card, a chargeback raised afterwards, a prepaid card, payment offered by a third party, insistence on paying in cash or by transfer from an account in another name. The most useful control remains a card pre-authorisation, the French empreinte bancaire, accepted on a card in the driver's name: not a debit but an authorisation, which ties up part of the card's limit without taking the money, then releases after the vehicle comes back, within the bank's own timescales. A card with immediate debit often cannot support it. If the holder of the means of payment cannot be identified, the vehicle does not leave.

Misappropriation of the vehicle

Failure to return at the end of the term, sub-letting through a parallel advertisement, departure beyond the territorial limits in the contract. The signals sit in the shape of the booking rather than in what the customer says: a long duration on a high-value vehicle, insistence on unlimited mileage and on a trip outside France, a request for delivery away from the agency, manufactured urgency, a contact reachable only by messaging.

The weak signals that justify one more check

None of these signals identifies a fraudster: each one says a piece of information is missing from the file. The right reaction is not an immediate refusal, it is the next question.

  • The name on the bank card differs from that of the declared driver.
  • The licence arrives as a photocopy, as a picture on a phone, or with a photograph hard to match to the face.
  • The proof of residence is old, illegible, or carries an address at odds with the rest of the file.
  • The booking is for the top of the fleet, for immediate departure, outside usual opening hours.
  • The customer refuses the pre-authorisation, switches means of payment at every request, or wants to pay through a third party.
  • The trip described matches neither the duration nor the mileage booked, and the phone number given stays unreachable.

Proportionate checks, the same for everyone

A check is defensible when it is written down, proportionate, and applied to everyone in the same way. That is what protects you from an accusation of discriminatory treatment while giving you a solid file if the dispute reaches a judge. The table below is a starting point to adapt to your fleet, not a regulatory standard.

The condition report, your decisive document

In a dispute it is not your memory that counts, it is your traceability. A joint, time-stamped, signed état des lieux, the French condition report, turns a disagreement into an established fact, whether the issue is contested damage or a vehicle that never came back.

  1. 1Photograph the vehicle from every angle, at handover and on return, odometer and tyres included.
  2. 2Walk round it with the customer present and have the document signed on the spot, never after they have left.
  3. 3Note that the mandatory in-car equipment is present, including the warning triangle and the high-visibility vest.
  4. 4Keep the contract, the documents checked and written extensions in a single file the whole team can reach.

Once the fraud has happened: the steps in France

A delay is not automatically a criminal offence, and the legal classification is not yours to make. Rules change: check the applicable procedure with the official source, service-public.fr, or with your local commissariat or brigade de gendarmerie, the police station or gendarmerie unit for your area.

  1. 1Start with traceable contact: a call followed by something in writing, keeping proof of sending.
  2. 2Send a mise en demeure, a formal notice to return the vehicle, by registered letter with acknowledgement of receipt.
  3. 3File a complaint at the commissariat or the brigade de gendarmerie, or write to the procureur de la République, the public prosecutor: it is for the prosecution service to settle on a classification, for instance abus de confiance, breach of trust as the Code pénal defines it.
  4. 4Report the vehicle when you file the complaint, so it can be entered in the fichier des véhicules volés, the register of stolen vehicles.
  5. 5Open the civil route if you need it, since that is where return of the vehicle and compensation are decided, and tell your insurer within the deadlines in your policy.

Tightening up without driving away good customers

The risk, when you harden your checks, is losing the honest customers, who simply go elsewhere. The balance comes from transparency: announce the security deposit, the documents required and the territorial limits before the booking, not at the counter. A customer who has been told accepts a check; a customer taken by surprise experiences it as suspicion.

That is one of the attractions of a marketplace such as DRIVO for an independent agency: verified profiles and reviews, the security deposit and what is included visible before booking, instant confirmation, free cancellation up to 48 hours before pick-up, automatic payouts through Stripe, and a booking, calendar and fleet management back-office that keeps the history in one place. Listing carries no sign-up fee and no monthly subscription, and commission applies only to completed bookings. But no marketplace runs your checks for you: verifying the licence, the identity document and the means of payment stays your professional act, at every departure.

Can a rental operator check how many licence points a customer has left?

No, the French national driving licence register is not open to rental professionals. You can check the original document, its apparent validity and its consistency with the other papers, and include in the contract a declaration by the driver that the licence is valid.

What should I do if the vehicle is not returned on the agreed date?

Try traceable contact, then send a mise en demeure by registered letter with acknowledgement of receipt. If the vehicle still does not come back, file a complaint at the police station or gendarmerie, or write to the public prosecutor. A simple delay is not necessarily a criminal offence: that assessment belongs to the prosecution service.

May I keep a copy of the licence and the identity document?

Only for a defined purpose, with strictly necessary data, a limited retention period, secure storage and the customer informed. The rules change: rely on the guidance of the CNIL, the French data protection authority, rather than on trade habit.

Does refusing a rental expose the agency to legal risk?

You may refuse on an objective, documented ground applied to everyone the same way: a missing document, a means of payment that cannot be verified, an inconsistent file. The ground must be recorded. A refusal based on origin, name, appearance or place of residence is unlawful.

Does a marketplace reduce the risk of fraud?

It moves the point of entry: verified profiles and reviews, payment and payouts handled through Stripe, the security deposit visible before booking, history kept in the back-office. The counter checks themselves remain yours to run.
